Contributions must not:

  5. Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
  6. Infringe on any copyright, database right, or trademark of another person.
  7. Be likely to deceive any person.
  8. Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  9. Promote any illegal activity.
  10. Be in contempt of court.
  11. Be threatening, abusive, invade another’s privacy, or cause annoyance, inconvenience, or needless anxiety.
  12. Be likely to harass, upset, embarrass, alarm, or annoy any other person.
  13. Impersonate any person or misrepresent your identity or affiliation.
  14. the impression that the Contribution originates from Sonohive Ltd if it does not.
  15. Advocate, promote, incite, or assist in any unlawful or criminal act, such as copyright infringement or computer misuse.
  16. Contain statements that could be interpreted as encouragement or inducement to commit, prepare, or instigate acts of terrorism.
  17.  Contain any advertising or promote services or web links to other sites.

Patient Case De-Identification Policy

Under this Acceptable Use Policy, all patient cases uploaded to our website must be de-identified. This means that the identity of each patient associated with the content (including images and case notes) must not be reasonably identifiable. Information that must not appear in any uploaded patient cases includes, but is not limited to:

  • Name
  • Initials
  • Date of birth
  • Address, including full or partial postal code
  • Telephone or fax numbers or contact information
  • Email addresses
  • Unique identifying numbers
  • Medical device identifiers
  • Web or internet protocol addresses linking to the patient
  • Biometric data
  • Facial photographs or comparable images
  • Names of relatives
  • Date of the study

If a case is unique in a way that could lead to the identification of an individual from the images alone, it should not be uploaded. This includes cases that have been featured in the media or exhibit particularly rare symptoms. Similarly, the accompanying textual information must also be free of identifying details and any other unnecessary information that could aid in identifying a patient.

Our policy does not override the individual policies of institutions. Users should ensure they are using images in accordance with their local guidelines.

We take patient privacy very seriously. Failure to adhere to these rules is a breach of our policy and Terms of Use. If you upload a case containing identifiable patient information, or from which a person can be reasonably identified, the case will be immediately deleted upon discovery, and we may take further action against you as permitted under our Terms of Use.

Breach of this Policy

If we determine that a breach of this acceptable use policy has occurred, we may take any action we deem appropriate. Non-compliance with this policy constitutes a material breach of the terms of use under which you are permitted to use our site, and may result in the following actions:

  1. Immediate, temporary, or permanent withdrawal of your right to use our site.
  2. Immediate, temporary, or permanent removal of any content you have uploaded to our site.
  3. Issuance of a warning to you.
  4. Legal proceedings against you for reimbursement of all costs on an indemnity basis, including but not limited to reasonable administrative and legal costs resulting from the breach.
  5. Initiation of further legal action against you.
  6. Disclosure of relevant information to law enforcement authorities as we reasonably deem necessary or as required by law.

We exclude liability for any actions we may take in response to breaches of this acceptable use policy. The actions listed above are not exhaustive, and we may take any other action we reasonably deem appropriate.

Which country’s laws apply to any disputes?

If you are a consumer, please note that the terms of this policy, its subject matter and its formation are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.

If you are a business, the terms of this policy, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England.
